Description of AutismPro

AutismPro is a product providing educational content and information to assist parents, educators and clinicians better understand, design and deliver effective autism intervention.

AutismPro is owned and provided by Virtual Expert Clinics Inc (“VEC”), incorporated in the Province of New Brunswick in Canada and in the United States.

AutismPro is available in Australia from a website (autismpro.com.au) (“the website”) which is owned and maintained by Autism Spectrum Australia ABN 12 000 637 267.

Use of the service

Your use of the website and AutismPro is subject to these Terms of Use.

Autism Spectrum Australia may change these Terms of Use from time to time and you should review these Terms of Use each time you use the website and AutismPro.

Your access to the website and use of AutismPro constitutes acceptance of these Terms of Use.

You will not use the website and AutismPro for any purpose which is illegal or prohibited by laws which apply to you.

Intellectual property

All intellectual property in relation to AutismPro belongs to VEC.

All intellectual property in relation to the website belongs to Autism Spectrum Australia.

You obtain no interest in the intellectual property of either AutismPro or the website by using AutismPro or the website.

You will not do anything which would or would be likely to infringe the intellectual property rights of either VEC or Autism Spectrum Australia which rights you acknowledge

Fees for the use of the service

Autism Spectrum Australia charges a fee for you to use AutismPro. 

The fees charged for the use of AutismPro are published in the AutismPro fee schedule on the website and are inclusive of GST (as that term is defined in A New Tax System (Goods and Services Tax) Act 1999).

Failure to pay the fee charged by Autism Spectrum Australia gives Autism Spectrum Australia the right to suspend or cancel your use of AutismPro.

Payments

Fees charged by Autism Spectrum Australia may be paid monthly or annually by credit card or direct debit.

Age and responsibility

You are of sufficient legal age (18 years or older) to access the website, use AutismPro and enter legal agreements.

Login and passwords

You are solely responsible for maintaining the confidentiality of your password and login name and for all activities that occur under your login name.

Autism Spectrum Australia accepts no liability for the misuse of passwords and login names.

Accuracy and usefulness of the content

Autism Spectrum Australia does not warrant the completeness, adequacy, accuracy or usefulness of AutismPro and the website.

Autism Spectrum Australia accepts no liability or responsibility for loss suffered as a result of reliance by you upon the completeness, adequacy, accuracy or usefulness of AutismPro and the website.

Loss and damage

Autism Spectrum Australia accepts no responsibility or liability in respect of any loss or damage howsoever caused (including through negligence) which you may directly or indirectly suffer or incur

• arising from your use of AutismPro; and
• in the event that the website is unavailable for any reason, including but not limited to computer or communications link downtime attributable to malfunction, upgrades or preventative or remedial maintenance activities.

The disclaimers set out in these Terms of Use do not attempt to exclude liability arising under statute if, and to the extent, such liability cannot be excluded.

Complaints and disputes

If you have any complaint about the service, you may contact Autism Spectrum Australia at autismpro@autismspectrum.org.au.

Your complaint will be dealt with fairly in accordance with Autism Spectrum Australia ’s complaints policy.  You can obtain a copy of this policy by contacting Autism Spectrum Australia at autismpro@autismspectrum.org.au

If we are unable to resolve your complaint you may take your complaint up through other avenues, including the Department of Fair Trading or Consumer Affairs in the state or territory in which you live.

Personal information

Autism Spectrum Australia respects the confidentiality of your personal information and your privacy.

Autism Spectrum Australia complies with the Australian Government’s National Privacy Principles. Autism Spectrum Australia complies with the following principles when collecting personal information:

• Information is not collected unless it is for a lawful purpose directly related and necessary to Autism Spectrum Australia’s purposes.
• The individual is aware of the purpose for which the information is collected and whether it is usual to disclose this information to another agency.
• The information is relevant, up to date and complete, and does not intrude unreasonably upon the personal affairs of the individual.
• Personal information is protected against unauthorised access, use or disclosure.
• Personal information will not be used without ensuring that it is accurate, up to date and complete. Information will not be used except for the purpose to which it is relevant.
• Personal information is not to be used for a purpose other than the purpose for which it was collected. Exceptions to this are if the individual has given consent, or it is authorised by law, or it is related directly to the purpose for which the information was obtained.

Consistent with these principles, the personal information you give will only be used to provide you with access to the website and AutismPro.

Your right to cancel the service

You may cancel your AutismPro service at any time.

If you cancel within 30 days of commencing your service, your service will be terminated immediately and you will receive a full refund of any payment you have made.

 If you cancel after 30 days of commencing your service, then:

·         your service will continue to be provided until the last day of your monthly billing period in which you gave notice to cancel; and

·          if you paid the annual fee, you will receive a refund of the balance of the annual fee less the discount you received for paying for the annual fee in advance.

Autism Spectrum Australia’s right to cancel the service

Autism Spectrum Australia may cancel the service by giving you at least 30 days’ notice.

Autism Spectrum Australia may also cancel the service immediately if any amount owing to us has not been paid by the due date and you have been advised of the failure to make the payment or if you otherwise breach these Terms of Use.

Responsibility for accessing the service

You are responsible for obtaining access to AutismPro from the website.  This responsibility includes, but is not limited to, payment of any fees to your Internet Service Provider.

You are responsible for providing all computer hardware and software required to access the website.

You should take your own precautions to ensure that the process you employ for accessing the website and AutismPro does not expose you to the risk of viruses or other forms of interference which may damage your computer system.

No medical or therapeutic claims

AutismPro is designed for education and information purposes only.  You should not interpret AutismPro or any advice provided by Autism Spectrum Australia for the purpose of assisting you to use AutismPro as being medical or therapeutic advice nor should you use AutismPro as a replacement for consulting with medical practitioners or clinicians.

No endorsement

Autism Spectrum Australia does not endorse any approach, treatment or option referred to on the website or in AutismPro.

Links to other sites

The website and AutismPro may include links to third party sites which are not related to Autism Spectrum Australia and over which Autism Spectrum Australia has no control or interest.

The appearance of those links on the website does not indicate any relationship between Autism Spectrum Australia and that third party or any endorsement by Autism Spectrum Australia of that third party, its site or the products or services which it may offer.

Governing law

The Agreement will be governed by and construed in accordance with the laws of the State of New South Wales and you and Autism Spectrum Australia expressly submit to the non-exclusive jurisdiction there.
